The Real ID Act is a federal law requiring states to meet certain federal standards when issuing driver's licenses or ID cards. The cards are accepted for federal purposes that are designated by the secretary of the U.S. Department of Homeland Security, such as access to federal buildings, or the boarding of commercial aircraft.
Federally compliant driver's licenses and ID cards are issued to US citizens, immigrants with permanent residence and non-immigrants with valid US Citizenship and Immigration Services documentation who can prove lawful status in the United States.
Immigrants who do not have valid US Citizenship and Immigration documentation can apply for a non-compliant driver's license or ID card. Individuals with Maryland driver's licenses or ID cards who do not have a verified social security number, and have maintained licenses or ID card without expiring for more than one year, can receive a federally non-compliant driver's license or ID card when they renew.
You must obtain a driver's license within 60 days after becoming a Maryland resident if you hold a noncommercial license. You have 30 days if you hold a commercial driver's license. Please refer to sources of proof for required documentation and instructions. You will need to visit a full service MVA office. If you are under eighteen (18) years of age, you must also have a parent/guardian accompany you and co-sign your application. If you have a valid out-of-state (or expired less than one year) license, you must also pass a vision test/screening and your license cannot be suspended, cancelled, disqualified or refused.

The Board interprets 554.051 (a) as authorizingthe agency to adopt rules for the proper administration andenforcement of the Act. The Board interprets 562.006 and562.0061 as authorizing the agency to adopt rules regardingthe prescription label.The statutes affected by this rule: Texas Pharmacy Act, Chap-ters 551 - 566 and 568 - 569, Texas Occupations Code.291.104. Operational Standards.(a) Licensing requirements.(1) A Class E pharmacy shall register annually or bienni-ally with the board on a pharmacy license application provided by theboard.(2) On initial application, the pharmacy shall follow theprocedures specified in 291.1 of this title (relating to Pharmacy Li-cense Application) and the provide the following additional informa-tion specified in 560.052(c) and (f) of the Act (relating to Qualifica-tions):(A) evidence that the applicant holds a pharmacy li-cense, registration, or permit issued by the state in which the pharmacyis located;(B) the name of the owner and pharmacist-in-charge ofthe pharmacy for service of process;(C) evidence of the applicant's ability to provide to theboard a record of a prescription drug order dispensed by the applicantto a resident of this state not later than 72 hours after the time the boardrequests the record;(D) an affidavit by the pharmacist-in-charge whichstates that the pharmacist has read and understands the laws and rulesrelating to a Class E pharmacy;(E) proof of creditworthiness; and(F) an inspection report issued not more than two yearsbefore the date the license application is received and conducted bythe pharmacy licensing board in the state of the pharmacy's physicallocation.(i) A Class E pharmacy may submit an inspectionreport issued by an entity other than the pharmacy licensing board of thestate in which the pharmacy is physically located if the state's licensingboard does not conduct inspections as follows:(I) an individual approved by the board who isnot employed by the pharmacy but acting as a consultant to inspect thepharmacy;(II) an agent of the National Association ofBoards of Pharmacy;(III) an agent of another State Board of Phar-macy; or(IV) an agent of an accrediting body, such as theJoint Commission on Accreditation of Healthcare Organizations.(ii) The inspection must be substantively equivalentto an inspection conducted by the board.(3) On renewal of a license, the pharmacy shall completethe renewal application provided by the board and, as specified in561.031 of the Act, provide an inspection report issued not morethan three years before the date the renewal application is receivedand conducted by the pharmacy licensing board in the state of thepharmacy's physical location.
(A) A Class E pharmacy may submit an inspection re-port issued by an entity other than the pharmacy licensing board of thestate in which the pharmacy is physically located if the state's licensingboard does not conduct inspections as follows:(i) an individual approved by the board who is notemployed by the pharmacy but acting as a consultant to inspect thepharmacy;(ii) an agent of the National Association of Boardsof Pharmacy;(iii) an agent of another State Board of Pharmacy; or(iv) an agent of an accrediting body, such as the JointCommission on Accreditation of Healthcare Organizations.(B) The inspection must be substantively equivalent toan inspection conducted by the board.(4) A Class E pharmacy which changes ownership shall no-tify the board within ten days of the change of ownership and apply fora new and separate license as specified in 291.3 of this title (relatingto Required Notifications).(5) A Class E pharmacy which changes location and/orname shall notify the board within ten days of the change and file foran amended license as specified in 291.3 of this title.(6) A Class E pharmacy owned by a partnership or corpo-ration which changes managing officers shall notify the board in writ-ing of the names of the new managing officers within ten days of thechange, following the procedures in 291.3 of this title.(7) A Class E pharmacy shall notify the board in writingwithin ten days of closing.(8) A separate license is required for each principal placeof business and only one pharmacy license may be issued to a specificlocation.(9) A fee as specified in 291.6 of this title (relating to Phar-macy License Fees) will be charged for the issuance and renewal of alicense and the issuance of an amended license.(10) The board may grant an exemption from the licensingrequirements of this Act on the application of a pharmacy located in astate of the United States other than this state that restricts its dispensingof prescription drugs or devices to residents of this state to isolatedtransactions.(11) A Class E pharmacy engaged in the centralized dis-pensing of prescription drug or medication orders shall comply with theprovisions of 291.125 of this title (relating to Centralized PrescriptionDispensing).(12) A Class E pharmacy engaged in central processing ofprescription drug or medication orders shall comply with the provisionsof 291.123 of this title (relating to Central Prescription or MedicationOrder Processing).(13) A Class E (Non-Resident) pharmacy engaged in thecompounding of non-sterile preparations shall comply with the provi-sions of 291.131 of this title (relating to Pharmacies CompoundingNon-Sterile Preparations).(14) A Class E (Non-Resident) pharmacy engaged in thecompounding of sterile preparations shall comply with the provisionsof 291.133 of this title (relating to Pharmacies Compounding SterilePreparations).(b) Prescription dispensing and delivery. 781b155fdc
